OVERVIEW

This service, including the Know Your Candle browser extension, website, and all associated tools (the “Service”), is operated by SIOWA (“we”, “us”, “our”). We offer this website and Service to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By creating an account, installing the Know Your Candle extension, or using any part of the Service, you agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including any additional terms, conditions, and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the Service.

Please read these Terms carefully before installing or using the Know Your Candle extension or website. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use the Service.

Any new features or tools added to the Service shall also be subject to these Terms. You can review the most current version of the Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically for changes. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

SECTION 1 - DEFINITIONS

  • Service: Refers to the Know Your Candle browser extension, website, and any related features or functionality.
  • User: Any individual or entity accessing or using the Service.
  • Know Your Candle Extension: A browser extension that overlays candlestick pattern markers and indicators on charts within third-party charting platforms (such as TradingView), based on mathematical analysis of price (OHLC) data.
  • Subscription: A recurring paid plan that unlocks features of the Service, billed and managed through our payment processor.

SECTION 2 - NATURE OF THE SERVICE AND RISKS ASSOCIATED WITH TRADING

Know Your Candle is a charting and visualization tool. It displays technical indicators and pattern markers on trading charts based on price (OHLC) data.

We do not provide trading signals, alerts, recommendations, or financial advice. Nothing displayed by the Service constitutes an offer, solicitation, or recommendation to buy, sell, or hold any financial instrument. All information is provided for informational and educational purposes only.

By using the Service, you acknowledge and accept that:

  • Trading in financial markets carries significant risk, including the risk of losses greater than your initial investment.
  • We do not guarantee the accuracy, completeness, availability, or timeliness of any indicator, pattern marker, or data displayed by the Service.
  • Any decision to enter, exit, or hold a position is made entirely by you, based on your own judgment and analysis.
  • We are not liable for any trading losses, missed opportunities, or other consequences arising from your use of, or reliance on, the Service.

Only trade with capital you can afford to lose, and seek independent financial advice to understand the risks involved in trading.

No Access to Your Trading Account or Funds

The Service does not connect to, access, or control your brokerage account, trading account, MetaTrader account, or funds. We have no ability to place, modify, or cancel trades on your behalf, and we never have access to or custody of your money.

Third-Party Dependencies

The Service operates on top of third-party charting platforms (such as TradingView) and relies on third-party market data providers (such as Yahoo Finance and Binance) and infrastructure providers to function. We are not responsible for interruptions, inaccuracies, failures, or limitations resulting from these third-party platforms or data sources. Any issues caused by third-party platforms are beyond our control, and you accept full responsibility for any resulting risks.

Use of any third-party platform, broker, or service in connection with the Service is at your own risk.

SECTION 3 - ELIGIBILITY AND ACCEPTABLE USE

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction of residence. You agree not to use the Service for any unlawful or unauthorized purpose, including violating any applicable intellectual property laws. A breach of these Terms may result in immediate termination of your access to the Service.

SECTION 4 - GENERAL CONDITIONS

We reserve the right to refuse or suspend the Service to anyone at any time. Your content (excluding payment information) may be transferred unencrypted across various networks and adapted to the technical requirements of connecting devices. Payment information is encrypted during transfer by our payment processor. You agree not to reproduce, copy, decompile, reverse-engineer, or exploit any portion of the Service without our express written permission.

SECTION 5 - ACCOUNTS AND AUTHENTICATION

Access to the Service requires signing in with a Google account. You are responsible for maintaining the security of your Google account and for all activity that occurs under your Know Your Candle account. You agree to notify us promptly of any unauthorized use of your account.

SECTION 6 - DATA COLLECTION AND USE

The Service reads chart context (such as ticker, exchange, timeframe, and visible chart range) from the charting platform you are using, and fetches market (OHLC) data from third-party providers, in order to detect patterns and render overlays. Your extension settings and authentication tokens are stored locally in your browser.

SECTION 7 - PAYMENT AND REFUND POLICY

By subscribing to a paid plan, you agree to provide current, complete, and accurate billing information. Subscription fees are billed automatically through our payment processor (Razorpay) based on the plan you select.

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged for the next billing cycle on the renewal date using the payment method on file. To avoid being charged for the next period, you must cancel before the renewal date.

Refunds

You may cancel your subscription at any time. We do not offer refunds for partial billing periods or unused portions of the Service. Any refund provided as a goodwill gesture may be subject to administrative fees to cover payment processing charges. These fees are not for profit and are intended to be fair to both parties.

SECTION 8 - INTELLECTUAL PROPERTY

The Service, including its software, design, branding, pattern-detection logic, and content, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, nor reverse-engineer or attempt to extract the source code of the extension, except as permitted by applicable law.

SECTION 9 - FORCE MAJEURE

We will not be held liable for any delay or failure in performance resulting from events beyond our reasonable control, including natural disasters, wars, cyberattacks, government actions, or service interruptions from third-party platforms or data providers.

SECTION 10 - ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We are not responsible if any information, indicator, or pattern marker displayed by the Service is inaccurate, incomplete, or outdated. Content provided by the Service is for general informational purposes and should not be relied upon as the sole basis for any trading decision. Use of the Service is at your own risk.

SECTION 11 - LIMITATION OF LIABILITY

The Service is provided on an “as-is” and “as-available” basis, without warranties of any kind, either express or implied, including but not limited to warranties of accuracy, reliability, availability, or fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

Comprehensive Waiver of Liability

To the maximum extent permitted by law, we will not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of, or inability to use, the Service, including financial losses, lost trading opportunities, downtime, or errors in displayed data. This applies regardless of whether such damages arise from your trading decisions, service interruptions, third-party failures, or system errors. You are solely responsible for your trading decisions and their consequences.

SECTION 12 - USER RESPONSIBILITY AND SECURITY

You are responsible for maintaining the confidentiality of your account credentials and for the security of the device on which the extension is installed. You agree to notify us promptly of any unauthorized access to, or breach of security related to, your account.

SECTION 13 - PROHIBITED USES

You may not use the Service to:

  • Violate any applicable law or regulation, including financial regulations
  • Infringe the intellectual property rights of others
  • Harass, abuse, or discriminate against others
  • Upload or distribute malicious code, malware, or spam
  • Attempt to gain unauthorized access to the Service, its infrastructure, or other users' accounts
  • Reverse-engineer, scrape, or systematically extract the Service's pattern-detection logic or outputs for use in a competing product

We reserve the right to terminate access to the Service for any prohibited use.

SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless us and our affiliates from any claims, liabilities, or damages arising from your breach of these Terms, your use of the Service, or your violation of any law or third-party rights.

SECTION 15 - THIRD-PARTY LINKS AND PLATFORMS

The Service may include links to, or operate on top of, third-party websites and platforms (such as TradingView). We are not responsible for examining or evaluating the content, accuracy, or practices of third-party platforms and will not be liable for any damages arising from your use of them. We encourage you to review the policies of any third-party platform before use.

SECTION 16 - TERMINATION

These Terms remain in effect until terminated by you or us. We may terminate or suspend your access to the Service at any time if you breach these Terms. You remain liable for all charges incurred up to the date of termination.

SECTION 17 - GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India, with courts in Mumbai, Maharashtra having exclusive jurisdiction.

SECTION 18 - DISPUTE RESOLUTION

In the event of a dispute arising from these Terms, both parties agree to first attempt resolution through good-faith negotiations. If negotiations fail, the dispute shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India, unless otherwise required by applicable consumer protection law.

SECTION 19 - SEVERABILITY

If any provision of these Terms is deemed unenforceable, it shall be severed from the Terms without affecting the enforceability of the remaining provisions.
